Our lawful basis will normally be performance of our contract with you or our legitimate interests in delivering services to a business or organisation you represent.

Managing our client relationships

We do not intentionally submit sensitive personal information to generative AI systems unless there is a clear reason to do so and appropriate safeguards are in place.

Where practical, information may be removed, reduced, anonymised or generalised before AI tools are used.

AI-generated or AI-assisted material used in our professional work remains subject to human review and judgement.

TPG Design does not currently use artificial intelligence to make solely automated decisions about website visitors or clients that have legal or similarly significant effects on them.

If this changes, we will update this privacy notice and provide any additional information required by law.

7. Sharing personal information

We do not sell your personal information.

We may share information with trusted suppliers and service providers where this is reasonably necessary to operate our business or provide services.

Depending on the work being undertaken, these may include providers of:

  • website analytics
  • website security and monitoring
  • customer relationship management
  • website development platforms
  • content and design software
  • artificial intelligence services
  • backup and technical support services

Examples of technology providers we may use can include Google, Microsoft, WordPress, Squarespace, Cloudflare and other specialist suppliers.

The particular suppliers used can change as technology and our services evolve.

We expect service providers handling personal information on our behalf to protect that information and use it only for appropriate purposes.

We may also disclose information where required by law, regulatory authorities, HM Revenue & Customs, courts, law enforcement or other competent authorities.

If TPG Design Limited, or substantially all of its assets, were sold, transferred or reorganised, relevant personal information may be transferred as part of that process subject to appropriate safeguards.

Some of the technology and cloud services we use operate internationally.

This means personal information may occasionally be stored or processed outside the United Kingdom.

Where a restricted international transfer of personal information takes place, we take reasonable steps to ensure that an appropriate mechanism is in place.

  • the UK Extension to the EU-US Data Privacy Framework where applicable

9. Keeping information secure

We take reasonable technical and organisational measures to protect personal information against:

No website, email system or internet transmission can be guaranteed to be completely secure, but we take reasonable steps appropriate to the nature of the information we hold.

Where required by law, we will notify affected individuals and the ICO of qualifying personal data breaches.

10. How long we keep information

We do not keep personal information for longer than reasonably necessary.

The appropriate retention period depends on:

  • why we collected the information
  • the nature of our relationship with you
  • contractual requirements
  • legal and regulatory requirements
  • accounting and taxation obligations
  • whether information may be needed to establish, exercise or defend legal claims

As a general guide:

Enquiries

Information relating to enquiries that do not become client projects will generally be retained only for as long as reasonably necessary for follow-up and business record purposes.

Client records

Core client, project and correspondence records may be retained for the duration of the relationship and for an appropriate period afterwards.

Financial records

Certain accounting and transaction information will normally be retained for at least six years where required for UK tax and accounting purposes.

Website development files and backups

During a website project we may temporarily hold copies of websites, databases, content, images or related files.

Once a website has been completed and handed over, working copies and backups held specifically for development purposes may be deleted when they are no longer reasonably required, subject to any separate support, hosting or maintenance arrangement.

Clients remain responsible for ensuring appropriate ongoing backups of websites under their control unless backup services form part of an agreement with TPG Design.

Anonymised information

Information that has been genuinely anonymised so that it can no longer identify an individual may be retained and used for longer periods.

11. Your data protection rights

Depending on the circumstances and the lawful basis on which we process your information, UK data protection law may give you rights including:

  • the right to be informed about how your information is used
  • the right to access personal information we hold about you
  • the right to ask us to correct inaccurate information
  • the right to request deletion of your information in certain circumstances
  • the right to ask us to restrict processing in certain circumstances
  • the right to object to certain types of processing
  • the right to data portability in certain circumstances
  • the right to withdraw consent where processing is based on consent
  • rights relating to certain automated decisions

You also have an absolute right to object to the use of your personal information for direct marketing.

There is normally no charge for exercising your data protection rights, although the law allows organisations to charge a reasonable fee or refuse certain requests where they are manifestly unfounded or excessive.

12. Marketing communications

You can ask us to stop sending marketing communications at any time.

You can:

  • use the unsubscribe link included in marketing emails where provided; or
  • email tpg@tpg-design.com.

Opting out of marketing will not prevent us from sending service-related communications concerning an existing project, contract or client relationship.

We do not sell personal information to third parties for marketing.

Our website may contain links to websites, services or platforms operated by other organisations.

We are not responsible for the privacy practices of those organisations.

If you follow a link to another website or service, we recommend reading its own privacy information.
